New York probate attorneys.

Hire a New York probate attorney who will file a copy of the will along with a certified copy of the death certificate of the will maker in the New York Surrogate Court. Each estate plan is unique to an individual and what they will leave behind upon their death.  The will, or trust dictates what happens to property, who will raise minor children, and how an individual will spend their last days, in the event of long term illnesses where an individual may not be able to speak for themselves, along with naming a person to carry out prescribed wishes (executor).  Closing out New York estates can be time-consuming and dragged out depending upon the nature of the assets left to distribute and events where named beneficiaries, or others  will contest a will.  Experienced probate lawyers can be instrumental in the smooth processing of probate actions.

COVID-19 impacts to estate planning.

The worldwide pandemic has de-stabilized much of America, but impacted New York State gravely during the early part of 2020 and beyond, leaving individuals to wonder if their estate plans are current, or if they should set up a plan to cover their loved ones in the event of an untimely death due to COVID-19, or complications.  Estate planning may be one small mechanism in decreasing anxiety of New York residents.  Worries surrounding the inability to handle a person’s affairs if they become sick, and/or die can be resolved by discussions with family members, loved ones, and business partners as to protections for businesses and living accommodations that include primary residential property.  Individuals should consult with New York Estate Planning attorneys to protect the home that shields their loved ones, especially during this health crisis.

Special considerations.

During these periods of shelter-in-place mandates,  New York Governor Andrew Cuomo issued an executive order permitting remote witnessing of wills, powers of attorney, health care proxies, deeds, and other documents. Video notarization with specific requirements for communication between individuals signing important documents, witnesses and supervising attorneys was also issued to allow New York residents the ability to update, or create new estate planning documents in light of dangers to their health and welfare.

Will administration.

A probate attorney will do their best to effectively and expediently administer the will to save an executor the frustration of holding up payment on bills and costs related to the decedent. These can include paying off creditors, burial costs, and upkeep on property for example, along with fees for professionals who perform services for the benefit of the estate such as appraisals.
